The past decade has witnessed escalating legal and ethical challenges to the diagnosis of death by neurologic criteria. The legal tactic of demanding consent for the apnea test, if successful, can halt the DNC. However, US law is currently unsettled and inconsistent in this matter. Consent has been required in several trial cases in Montana and Kansas but not in Virginia and Nevada. In this paper, we analyze and evaluate the legal and ethical bases for requiring consent before apnea testing (...) and defend such a requirement by appealing to ethical and legal principles of informed consent and battery and the right to refuse medical treatment. We conclude by considering and rebutting two major objections to a consent requirement for apnea testing: a justice-based objection to allocate scarce resources fairly and a social utility objection that halting the diagnosis of brain death will reduce the number of organ donors. This paper surveys attempts in the recent literature to offer a modal condition on knowledge as a way of resolving the problem of scepticism. In particular, safety-based and sensitivity-based theories of knowledge are considered in detail, along with the anti-sceptical prospects of an explicitly anti-luck epistemology.

Much of the recent debate regarding scepticism has focussed on a certain template sceptical argument and a rather restricted set of proposals concerning how one might deal with that argument. Throughout this debate the ‘Moorean’ response to scepticism is often cited as a paradigm example of how one should not respond to the sceptical argument, so conceived. As I argue in this paper, however, there are ways of resurrecting the Moorean response to the sceptic. In particular, I consider the prospects (...) for three such proposals in this regard: a classical epistemic internalist neo-Mooreanism, a classical epistemic externalist neo-Mooreanism, and a non-classical McDowellian epistemic internalist neo-Mooreanism, and maintain that the last two of these proposals (both of which make appeal to a disjunctivist account of perception, broadly conceived) merit further exploration. Indeed, I claim that a suitably qualified version of neo-Mooreanism would actually sit quite well with the general philosophical motivations behind other key anti-sceptical views and I argue that given this fact neo-Mooreanism is actually at a dialectical advantage relative to other views when it comes to dealing with the sceptical problem as it is typically conceived. It is claimed that McDowell’s treatment of scepticism offers a potential way of resurrecting the much derided ‘Moorean’ response to scepticism in a fashion that avoids the problems facing classical internalist and externalist construals of neo-Mooreanism. I here evaluate the prospects for a McDowellian neo-Mooreanism and, in doing so, offer further support for the view.

All three models coexist in natural languages and are represented both in their grammatical systems and in the text-building discourse strategies speakers and authors apply to.

The recent popularity of contextualist treatments of the key epistemic concepts has tended to obscure the differences that exist between the various kinds of contextualist theses on offer. The aim of this paper is to contribute towards rectifying this problem by exploring two of the main formulations of the contextualist position currently on offer in the literature—the 'semantic' contextualist thesis put forward by Keith DeRose and David Lewis, and the 'inferential' contextualist thesis advanced by Michael Williams. It is argued that (...) by evaluating these theses in the light of each other one can gain a deeper understanding of the contextualist position. The chapter begins by exploring a philosophical case study of the use of intuitions — viz., the debate regarding the problem of radical scepticism, paying particular attention to key figures within this debate such as Barry Stroud, John Austin, and Ludwig Wittgenstein. It contends that this debate demonstrates something interesting about the nature of intuitions and the role that they can play in philosophical inquiry. In particular, the chapter argues that we need to think of the philosophical use of intuitions (...) as at least sometimes involving a significant level of expertise. The De Officiis of Ambrose, Bishop of Milan is a key text of early Christian literature. Based on a work by the Roman writer, Cicero, it presents the first systematic account of Christian ethics. Reductive intellectualists hold that knowledge-how is a kind of knowledge-that. For this thesis to hold water, it is obviously important that knowledge-how and knowledge-that have the same epistemic properties. In particular, knowledge-how ought to be compatible with epistemic luck to the same extent as knowledge-that. It is argued, contra reductive intellectualism, that knowledge-how is compatible with a species of epistemic luck which is not compatible with knowledge-that, and thus it is claimed that knowledge-how and knowledge-that come apart.

Music is a deeply entrenched human phenomenon. In this article, I argue that its evolutionary origins are intrinsically intertwined with the incremental anatomical, cognitive, social, and technological evolution of the hominin lineage. I propose an account of the evolution of Plio-Pleistocene hominins, focusing on traits that would be later implicated in music making. Such traits can be conceived as comprising the musicality mosaic or the multifaceted foundations of musicality. I then articulate and defend an account of protomusical behaviour, drawing theoretical (...) licence from the social brain framework of Robin Dunbar and colleagues, as well as the evolutionary framework for human culture and cooperation developed by Kim Sterelny. The role of gene-culture co-evolution and niche construction is brought to the fore in articulating the evolutionary account. Finally, I defend the view that music subsequently developed via processes of social learning and cumulative culture. (shrink)

In particular, the disjunctivist account of perceptual experience is set out, along with the manner in which it intersects with related positions such as naïve realism and intentionalism, and it is shown how this account can be used to a motivate an anti-sceptical proposal. This article describes a logic of distinction and succession within the late-twentieth-century Leningrad-St. Petersburg cultural field, whereby consecutive intelligentsia mainstreams were replaced by their avant-garde peripheries. In this dynamic picture of socio-cultural transformations, I propose a working hypothesis of a repeated stratification of the field into an ‘official’, an ‘unofficial’, and a third ‘non-aligned’ intelligentsia. This hypothesis is tested in reference to the ‘non-aligned’ groups founded by the avant-garde artist and ideologue Timur Novikov (1958–2002). Three major shifts are described: from (...) the politicized late-Brezhnevite early 1980s to the apolitical radicalism of Novikov’s New Artists; from this anarchistic underground, through the perestroika era, to the playful ‘classicism’ of the New Academy of Fine Arts in the 1990s; and from this postmodern international orientation to an arch-reactionary, neo-imperial posturing at the turn of the 2000s. Lastly, this ‘non-aligned’ intelligentsia is suggested as a possible precedent, or, indeed, a model for understanding other historically significant avant-garde peripheries, which commonly seek to distinguish themselves from (often mutually-exclusive) centres. During his lifetime, Sir Ivor Jennings was well known as the author of several standard books on constitutional law. He acted as constitutional adviser to the governments of Ceylon and Pakistan and was Vice-Chancellor of the University of Ceylon. This 1956 book followed in the tradition of his earlier The British Constitution and is a clear statement by an expert with a characteristically practical point of view. It is principally concerned with a practical problem: what constitution shall be given (...) to a new country about to govern itself for the first time? Published at a time when colonial empires were moving more or less peaceably towards self-government, it was based on a series of broadcast talks originally commissioned by the BBC in the belief that the experiences gained in Asia were in principle applicable to other countries approaching self-government. In this paper, I do three things. First, I offer an overview of an anti- luck epistemology, as set out in my book, Epistemic Luck. Second, I attempt to meet some of the main criticisms that one might level against the key theses that I propose in this work. And finally, third, I sketch some of the ways in which the strategy of anti- luck epistemology can be developed in new directions.

The article proposes to further develop the ideas of the Extended Evolutionary Synthesis by including into evolutionary research an analysis of phenomena that occur above the organismal level. We demonstrate that the current Extended Synthesis is focused more on individual traits (genetically or non-genetically inherited) and less on community system traits (synergetic/organizational traits) that characterize transgenerational biological, ecological, social, and cultural systems. In this regard, we will consider various communities that are made up of interacting populations, and for which the (...) individual members can belong to the same or to different species. Examples of communities include biofilms, ant colonies, symbiotic associations resulting in holobiont formation, and human societies. The proposed model of evolution at the level of communities revises classic theorizing on the major transitions in evolution by analyzing the interplay between community/social traits and individual traits, and how this brings forth ideas of top-down regulations of bottom-up evolutionary processes (collaboration of downward and upward causation). The work demonstrates that such interplay also includes reticulate interactions and reticulate causation. In this regard, we exemplify how community systems provide various non-genetic ‘scaffoldings’, ‘constraints’, and ‘affordances’ for individual and sociocultural evolutionary development. Such research complements prevailing models that focus on the vertical transmission of heritable information, from parent to offspring, with research that instead focusses on horizontal, oblique and even reverse information transmission, going from offspring to parent. We call this reversed information transfer the ‘offspring effect’ to contrast it from the ‘parental effect’. We argue that the proposed approach to inheritance is effective for modelling cumulative and distributed developmental process and for explaining the biological origins and evolution of language. It is nowadays taken for granted that the core radical sceptical arguments all pivot upon the principle that the epistemic operator in question is 'closed' under known entailments. Accordingly, the standard anti-sceptical project now involves either denying closure or retaining closure by amending how one understands other elements of the sceptical argument. However, there are epistemic principles available to the sceptic which are logically weaker than closure but achieve the same result. This essay is a contribution to the field of institutional studies in that it treats the State as a substantial phenomenon, composed of institutions that require analysis in their own right. Here, the focus is on the political form of African states from the 1960s to the 1980s. On the one hand, I will follow Bourdieu here in insisting that the study of government demands that we know something of the history of political thought (la pensée politique). This simple observation (...) is seldomly applied when it comes to politics in postcolonial Africa. On the other, I use Peter Wagner´s concept of modernity to show that struggles against colonialism and Imperialism and the pursuit of self-determination for African and Asian peoples are unambiguously struggles against domination and for autonomy. The emergence of Third World nationalism (and the Non-Aligned Movement) is an event, therefore, firmly in modernity. So too is the phenomenon of the One-party state in Africa. (shrink)

This paper explores the hypothesis that proper names serve as anchors identifying the individuals in the possible or real world. This hypothesis is tested on Old Icelandic narratives. A prominent feature of Old Icelandic sagas is that the narrative matter is not quite new. A Saga is reliable iff it refers to the events relevant for its audience and accepted as true by the whole community. I argue that proper names must be regarded as references to the background knowledge of (...) the medieval audience. I follow two contemporary Sagas based on the fresh events and show that proper names in a Saga mind were arranged in form of a database, each type of a personal designation having its charachteristic text-building profile. The form of the name and its frequency in the Saga are linked with the rank of the character. The high number of people mentioned in the Sagas is explained by the fact that the Sagas aimed at describing the real world, where the names of the individuals and the events they were involved cross-identified each other. Every character had its rigid identifiers. The total amount of propria is always higher than the number of active figures. I classify the Saga characters into five ranks and discuss their information-structural profiles. (shrink)

To determine what the speaker in a cooperative dialog meant with his assertion, on top of what he explicitly said, it is crucial that we assume that the assertion he gave was optimal. In determining optimal assertions we assume that dialogs are embedded in decision problems (van Rooij 2003) and use backwards induction for calculating them (Benz 2006). In this paper, we show that in terms of our framework we can account for several types of implicatures in a uniform way, (...) suggesting that there is no need for an independent linguistic theory of generalized implicatures. In the final section, we show how we can embed our theory in the framework of signaling games, and how it relates with other game theoretic analyses of implicatures. (shrink)

A certain construal of the Gettier problem is offered, according to which this problem concerns the task of identifying the anti-luck condition on knowledge. A methodology for approaching this construal of the Gettier problem—anti-luck epistemology—is set out, and the utility of such a methodology is demonstrated. It is argued that a range of superficially distinct cases which are meant to pose problems for anti-luck epistemology are in fact related in significant ways.
